These Terms of Service set forth the legally binding terms and conditions which are applicable to your use of any of the Applications ("App" or "Apps") from MidPlay Studio. MidPlay Studio may also refer as "we" or "us" in this policy.
By installing, accessing or using the Apps you confirm that you have read and understood the Terms and our Privacy Policy, and that you agree to be bound by them. If you do not agree, please do not use the Apps.
01 Agreement
1.1 License
MidPlay Studio grants you a non-transferable, non-exclusive license to use for your personal use, and to copy for downloading, installing and executing, the number of copies authorized by the download site of each App on a mobile device that you own or control.
1.2 Certain Restrictions
You shall not license, sell, rent, lease, transfer, assign, distribute, host, or otherwise commercially exploit any App; modify, reverse engineer, or build a competitive service; or remove proprietary notices, except where prohibited by law.
1.3 Local Laws
You are solely responsible for compliance with all applicable laws, including export and import regulations.
1.4 Modification
MidPlay Studio reserves the right to modify, suspend, or discontinue the Apps or any part thereof with or without notice and without liability.
1.5 Ownership
Apps are licensed, not sold. MidPlay Studio and its licensors own all rights in the Apps, excluding User Content. No ownership rights are conveyed by this Agreement.
02 User Content
You are solely responsible for content you create, upload, or distribute via any App. You grant MidPlay Studio a worldwide, royalty-free license to use that content to display it on any App. Feedback you provide may be used freely by MidPlay Studio.
You agree not to upload content that infringes rights, is harmful, illegal, or abusive, and not to distribute malware, scrape user data, or interfere with App servers or other users.
03 Term and Termination
This Agreement remains in effect while you use the App. MidPlay Studio may suspend or terminate access at any time for any reason, including Acceptable Use Policy violations. Upon termination, your right to use the App ends immediately.
04 Indemnity
You agree to defend, indemnify and hold harmless MidPlay Studio from claims arising from your use of any App, your User Content, or your violation of this Agreement.
05 Third Parties
App availability may depend on Application Stores. This Agreement is between you and MidPlay Studio, not the Application Store. Third Party Services and other users' content are used at your own risk.
06 Disclaimers
APPS ARE PROVIDED "AS-IS" AND AS AVAILABLE. MidPlay Studio disclaims warranties of merchantability, fitness for a particular purpose, title, quiet enjoyment, accuracy, or non-infringement to the fullest extent permitted by law.
07 Limitation on Liability
IN NO EVENT SHALL MidPlay Studio BE LIABLE FOR LOST PROFITS OR INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL OR PUNITIVE DAMAGES. LIABILITY IS LIMITED TO THE AMOUNT YOU PAID MidPlay Studio IN THE PRIOR 12 MONTHS (IF ANY).
08 Fees
You agree to pay applicable fees for Apps you download and for any in-App purchases you make.
09 General
MidPlay Studio may update these Terms. Continued use after notice indicates acceptance. Notices to MidPlay Studio should be sent to info@midplaygames.com. This Agreement is the complete agreement regarding the Apps and supersedes prior agreements.
